These Terms & Conditions govern your use of the Klayvi website at klayvi.com and any purchase you make from us. By browsing our website or placing an order, you agree to these terms in full. Please read them carefully before proceeding.

If you do not agree with any part of these terms, you should not use our website or purchase our products.

Klayvi is a premium handmade clay cookware, drinkware, home decor, and natural care brand based in Gurgaon, Haryana, India. References to “Klayvi”, “we”, “us”, or “our” throughout these terms refer to Klayvi and its authorised operators.

1. Use of Our Website

1.1 Eligibility

By using klayvi.com, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and are accessing our website for lawful purposes. If you are purchasing on behalf of a business or organisation, you confirm that you have the authority to bind that entity to these terms.

1.2 Permitted Use

You may use our website to browse our products, place orders, manage your account, and access our content — including care guides, batch reports, and educational material about clay cookware. You may not use our website for any unlawful purpose, to transmit harmful or fraudulent content, to scrape or reproduce our product descriptions, images, or laboratory data without our written consent, or to interfere with the operation of the site in any way.

1.3 Account Responsibility

If you create an account on klayvi.com, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at contact@klayvi.com if you suspect any unauthorised use of your account. We are not liable for any loss arising from your failure to keep your credentials secure.

1.4 Website Availability

We make every reasonable effort to keep klayvi.com available and functioning at all times. However, we do not guarantee uninterrupted access. The website may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by such unavailability.

2. Our Products

2.1 Handmade Nature

Every Klayvi product is individually hand-thrown by a named artisan in the Delhi-NCR region. Because our pieces are made by hand on a potter’s wheel and fired in a kiln, there will be natural and expected variation between individual pieces — in wall thickness, surface texture, colour tone, and minor dimensional measurements. These variations are inherent to the craft and are not defects. They are the proof that your piece was made by a person, not a machine.

Product photographs on our website are representative. Your specific piece may vary slightly in colour and surface character from what is shown, depending on the natural mineral composition of the clay batch and kiln conditions on the day of firing. This is normal and expected.

2.2 Accuracy of Product Information

We make every reasonable effort to ensure that product descriptions, laboratory data, specifications, and pricing on our website are accurate and up to date. In the unlikely event of an error, we reserve the right to correct it without prior notice. If you have placed an order based on inaccurate information, we will contact you before dispatching and give you the option to proceed or cancel for a full refund.

2.3 Laboratory Reports and Safety Claims

Every Klayvi product is XRF tested at source and ICP-OES tested on the finished product before dispatch. Batch-specific laboratory reports from NABL-accredited facilities are published on our website and linked via QR code on the product base.

The laboratory values published represent the actual measured results for each specific production batch. These figures are accurate at the time of testing. We make no claim beyond what the published data states. Our content referencing ICMR-NIN guidelines, US EPA classifications, and published food science research is provided for educational context. We do not claim that our products diagnose, prevent, or treat any medical condition. All health-related content on our website is informational and should not be construed as medical advice.

2.4 Product Availability

All products on our website are subject to availability. Because we operate a zero-inventory, made-to-order model, most items are produced specifically in response to confirmed orders. Estimated dispatch times are provided on each product page. If a product becomes unavailable after you have placed an order, we will notify you and offer either an alternative or a full refund.

3. Orders and the Contract Between Us

3.1 Placing an Order

When you place an order on klayvi.com, you are making an offer to purchase the items in your basket at the price shown, subject to these terms. Your order constitutes an offer only — it is not confirmed until we accept it.

3.2 Order Confirmation

Once you complete checkout, you will receive an automated order confirmation email. This confirms that we have received your order and your payment has been processed. It does not constitute our acceptance of your order.

Our acceptance of your order — and the formation of a binding contract between us — occurs when we send you a dispatch confirmation email confirming that your item has been prepared and handed to our courier partner. If we are unable to fulfil your order for any reason, we will let you know and issue a full refund.

3.3 Cancellations

Because our products are made to order, cancellations can only be accepted within 12 hours of placing your order, before production has commenced. To cancel within this window, email contact@klayvi.com immediately with your order number. Once an artisan has begun production on your order, cancellation is no longer possible and standard return terms apply.

3.4 Corporate and Bulk Orders

Corporate gifting orders, bulk orders of 10 or more units, and custom-engraved orders are governed by a separate corporate order agreement issued at the time of the order. In the event of any conflict between that agreement and these Terms & Conditions, the corporate order agreement takes precedence for those specific orders. 4. Pricing and Payment

4.1 Pricing

All prices displayed on klayvi.com are in Indian Rupees (₹) and are inclusive of applicable GST unless otherwise stated. Shipping charges, where applicable, are calculated and displayed at checkout before you confirm your order.

We reserve the right to change our prices at any time. The price you pay is the price displayed at the time you confirm your order. If a pricing error is discovered after your order is placed, we will contact you before dispatching and give you the option to proceed at the correct price or cancel for a full refund.

4.2 Payment

We accept payment via Razorpay, which supports UPI, credit cards, debit cards, net banking, and select digital wallets. All transactions are processed securely on Razorpay’s PCI-DSS compliant infrastructure.

We collect 100% payment upfront at the time of order. We do not offer cash on delivery (COD). This allows us to commence production promptly and ensures payment security for both parties. By placing an order, you authorise us to charge the full order value to your selected payment method at checkout.

4.3 Payment Failure

If your payment fails or is declined, your order will not be confirmed. You may attempt the transaction again with a different payment method. If payment was debited from your account but the order was not confirmed due to a technical error, we will investigate and issue a full refund within 5 to 7 working days.

4.4 GST and Invoicing

A GST-compliant tax invoice is generated for every order and emailed to you upon dispatch. If you require the invoice to reflect a business name and GSTIN, please provide these details in the order notes at checkout or email us within 12 hours of placing your order. We cannot amend invoices after dispatch.

5. Delivery

5.1 Dispatch Timelines

Estimated dispatch timelines are provided on each product page. Standard SKUs are typically dispatched within 5 to 7 working days. Larger pieces, festive season orders, and custom orders may have extended lead times, which are clearly communicated at the product and checkout stage.

Dispatch timelines are estimates, not guarantees. Delays may occur due to seasonal production constraints, artisan availability, monsoon season disruptions, or courier capacity during peak periods such as Diwali. We will communicate proactively if your order is likely to be delayed significantly.

5.2 Delivery

We ship across India via Shiprocket, Delhivery, Blue Dart, and Xpressbees, depending on your location and the value and fragility of your order. High-value and large orders are typically dispatched via Blue Dart for superior fragility protection.

Once your order has been dispatched, you will receive a tracking number by email and WhatsApp (if opted in). Klayvi is not responsible for delays caused by courier partners once your order has been handed over for dispatch.

5.3 Delivery Failures

If a delivery attempt fails because you are unavailable, an incorrect address was provided, or the package is refused, the courier will typically make one or two further attempts before returning the item to us. Additional delivery attempts or re-dispatch may incur a charge, which will be communicated to you before proceeding.

If an item is returned to us due to an incorrect address provided at checkout, you will be responsible for the cost of re-dispatch.

5.4 Risk and Ownership

Ownership of your Klayvi products passes to you at the moment of dispatch. Risk of loss or damage passes to you upon delivery — specifically, when the courier confirms delivery to your address. We strongly recommend inspecting your order upon receipt and notifying us within 24 hours of any damage or discrepancy.

5.5 International Shipping

At this stage, Klayvi ships domestically within India. Export orders for UAE, UK, and USA are available on a selective basis through our international programme. If you are located outside India and wish to place an order, please email contact@klayvi.com to discuss availability, shipping costs, applicable duties, and regulatory compliance requirements for your country.

6. Returns, Refunds, and Exchanges

Our complete returns and refunds policy is set out on our dedicated Refund and Returns Policy page, which forms part of these Terms & Conditions and should be read alongside them.

In summary:

Returns are accepted within 7 days of delivery for eligible items in unused, original condition
Products that have been seasoned, heated, or used are not eligible for return
Damaged-in-transit claims must be raised within 24 hours of delivery with photographic evidence
Our 3-year structural warranty applies to select premium-tier products

7. The Klayvi Circle Membership (Coming Soon)

7.1 Membership Terms

The Klayvi Circle is our optional paid membership programme, available at an annual fee as published on our website at the time of enrolment. Membership entitles you to benefits including early product access, an annual Revival Kit, priority customer support, and subscription-only content.

7.2 Renewal and Cancellation

Klayvi Circle memberships are annual. Unless you notify us at contact@klayvi.com at least 7 days before your renewal date, your membership will renew automatically at the then-current annual rate. You may cancel your membership at any time; however, we do not offer pro-rated refunds for unused portions of a membership period.

7.3 Membership Benefits

Membership benefits are subject to change. We will notify active members of any material changes to benefits at least 30 days in advance. If a benefit is removed that materially diminishes the value of the membership, you will have the option to cancel and receive a pro-rated refund for the unused period.

8. Intellectual Property

8.1 Our Content

All content on klayvi.com — including product descriptions, laboratory data, care guides, brand story copy, photography, the Klayvi K-leaf logo and brand identity, product names, taglines, and any other written or visual material — is the intellectual property of Klayvi and is protected by Indian copyright law and applicable international conventions.

You may not reproduce, copy, republish, distribute, adapt, or use any of our content for commercial purposes without our prior written consent. You may share links to our website and reference our publicly published content for non-commercial, informational purposes, provided you credit Klayvi as the source.

8.2 Our Trademarks

“Klayvi”, “Bio-Active Clayware”, “Aqua-Lock”, “Bone Kaolin”, “KLAYVI Circle”, and all associated product names and series names are proprietary to Klayvi. Use of these names in any form — including in search advertising, product listings on third-party platforms, or business names — without our written consent is prohibited.

8.3 Your Content

If you share reviews, photographs, testimonials, or other content about Klayvi products on our website or social media platforms and tag us or use our branded hashtags, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content for marketing and promotional purposes, with appropriate credit to you. We will always seek your explicit permission before using your content in paid advertising.

8.4 Batch Reports and Laboratory Data

Our batch laboratory reports are produced by NABL-accredited third-party laboratories. We publish them as a transparency measure. You may reference these reports for personal educational purposes. Reproducing them in full, misrepresenting their findings, or using them in a manner that implies an endorsement from the laboratory or from Klayvi beyond what the data states is prohibited.

9. User Conduct

When using klayvi.com or interacting with us via email, WhatsApp, or social media, you agree not to:

Submit false, misleading, or fraudulent information in any form
Place orders with no genuine intention to purchase
Use our website to transmit spam, malware, or harmful code
Attempt to gain unauthorised access to any part of our website or systems
Use automated tools, bots, or scrapers to extract content or data from our website
Post or transmit content that is defamatory, offensive, discriminatory, or in violation of any applicable law
Impersonate Klayvi or any of our team members or artisan partners

We reserve the right to suspend or terminate access to any account that violates these terms, and to take appropriate legal action where necessary.

10. Disclaimer of Warranties

Our products and website are provided on an “as is” basis. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

Our website will be error-free, uninterrupted, or free of viruses or other harmful components
The information on our website is complete, accurate, or current at all times
Any specific cooking result, flavour outcome, or nutritional benefit will be achieved through use of our products

The educational content on our website regarding clay cooking science, mineral contribution, biophilic benefits, and comparative cookware safety is provided in good faith based on published peer-reviewed research and regulatory guidance. We do not make clinical health claims. Individual results and experiences will vary.

11. Limitation of Liability

To the fullest extent permitted by applicable Indian law, Klayvi’s total liability to you in connection with any claim arising out of or in relation to your use of our website or the purchase of our products — whether in contract, tort, negligence, or otherwise — shall not exceed the total amount you paid to us for the specific order giving rise to the claim.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profit, loss of data, loss of goodwill, or loss of opportunity, even if we have been advised of the possibility of such damages.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable Indian law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Klayvi and its team members, artisan partners, and service providers from any claim, demand, loss, liability, or expense — including reasonable legal fees — arising out of or in connection with your breach of these Terms & Conditions, your violation of any applicable law or third-party right, or any content you submit to us or publish in connection with Klayvi.

13. Third-Party Links and Services

Our website may contain links to third-party websites, social media platforms, or services that we reference for informational purposes. We do not control these third-party sites and are not responsible for their content, privacy practices, or terms of service. A link from klayvi.com does not constitute an endorsement of the linked site.

We use third-party service providers — including Shopify, Razorpay, Klaviyo, Shiprocket, and others — to operate our business. Your use of these services is subject to their own terms and privacy policies in addition to ours.

14. Force Majeure

We shall not be in breach of these terms or liable for any delay or failure to perform our obligations where such delay or failure arises from circumstances beyond our reasonable control. This includes but is not limited to natural disasters, pandemic or epidemic conditions, government-imposed restrictions, severe weather events, monsoon-related production disruptions, strikes or industrial action by courier partners, or failures of third-party infrastructure.

Where a force majeure event affects our ability to fulfil your order, we will notify you as soon as reasonably practicable and work with you to find an appropriate resolution, which may include an extended delivery timeline or a full refund.

15. Governing Law and Disputes

These Terms & Conditions are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms or your purchase from Klayvi shall be subject to the exclusive jurisdiction of the courts located in Gurugram, Haryana, India.

Before initiating any formal legal proceedings, we ask that you contact us at contact@klayvi.com to allow us the opportunity to resolve the matter directly. We are committed to addressing concerns promptly and in good faith. Most issues can and should be resolved through a direct conversation.

16. Changes to These Terms

We reserve the right to update or amend these Terms & Conditions at any time. Changes will be published on this page with an updated “Last updated” date. Where changes are material, we will notify registered account holders by email.

Your continued use of our website or placement of orders after updated terms are published constitutes your acceptance of the revised terms. We encourage you to review this page periodically.

17. Severability

If any provision of these Terms & Conditions is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be severed from the remainder of these terms, which shall continue in full force and effect.

18. Entire Agreement

These Terms & Conditions, together with our Privacy Policy, Refund and Returns Policy, and any corporate order agreement issued in connection with a specific order, constitute the entire agreement between you and Klayvi with respect to your use of our website and purchase of our products. They supersede all prior agreements, representations, and understandings.
